These Privacy Policies are an integral part of the General Conditions (as defined below) so that the definitions used therein are reused in these Privacy Policies.

The purpose of these Privacy Policies is to inform Data Subjects about how their Personal Data is collected from the Site, how it is processed by Madosto and finally the Specific Rights (as defined below) enjoyed by the Data Subjects regarding these treatments as defined below.

Definitions

The following terms, whether used in the singular or plural in these Privacy Policies, will have the following definition:

• Intermediate Archiving: designates the movement of Personal Data which still presents an administrative interest for Madosto, (such as for example in the event of litigation and/or in the event of legal obligation) in a separate database, separated logically or physically and of which, in any state Therefore, access is restricted. • Concerned person : designates the natural person (Internet user, Customer, Subscriber) whose Personal Data is processed by Madosto;
• Regulations on Personal Data: means Law no. 78-17 of 6 January 1978 relating to data processing, data files and individual liberties, in application of the General Data Protection Regulation;
• Madosto: means the company Ecomeo OÜ, whose registered office is located at Lõõtsa tn 2a, 11415 Tallinn, Estonia, registered under number 16563515.
• Terminal(s): means the hardware equipment (computer, tablet, smartphone, telephone, etc.) used by the Person Concerned to consult or view the Site and/or any other digital medium published by a third party.

Legal bases for processing

In accordance with the Personal Data Regulations, the processing operations designated in these Privacy Policies are supported by a specific legal basis.

The Data Subject has consented to the processing of their Personal Data for one or more specific purposes.

The Site may have required the express consent of the Data Subject in order to carry out specific processing explained during this consent collection.

The processing is necessary for the performance of a contract to which the Data Subject is a party or for the execution of pre-contractual measures taken at the request of the Data Subject.

In order to use the Website and benefit from its services, the Person Concerned must have accepted at least the General Terms and Conditions of Use and, where applicable, the General Terms and Conditions of Sale and/or the General Terms and Conditions of Service. These documents formalise a contractual relationship between the Data Subject and Madosto, serving in particular as the legal basis for the collection and processing of the Data Subject's Personal Data by Madosto.

This Data is necessary to carry out a certain number of processing operations linked to the execution of the contractual relationship between the Data Subject and Madosto, the purposes of which are detailed in the paragraph “The purposes of the processing operations”.

The processing is necessary for compliance with a legal obligation to which it is subject.

The processing of Personal Data may also be necessary in order to comply with a legal obligation to which Madosto is subject, for example, the conservation of access logs to the Website, in accordance with Decree no. 2011-219 of 25 February 2011 relating to the conservation and communication of data enabling the identification of any person having contributed to the creation of content placed online.

Processing is necessary for the purposes of the legitimate interests pursued by Madosto or by a third party, unless the interests or fundamental rights and freedoms of the Data Subject which require protection of personal data are overridden, in particular where the Data Subject is a child.

Madosto may have a legitimate interest justifying the processing of the Personal Data of the Data Subject, such as for example the processing of Data strictly necessary for the purposes of fraud prevention.

In this case, Madosto ensures that the processing in question is indeed necessary to achieve its legitimate interest and evaluates the consequences of this processing on the Data Subject, in particular taking into account the nature of the Data processed, and the how they are treated.

Madosto ensures not to disregard the interest or fundamental rights and freedoms by allowing the Data Subject, at any time, to object to all or part of the processing described in these Confidentiality Policies, such as to implement its Specific Rights, under the conditions of the paragraph “Specific Rights”.

The purposes of the processing

The Personal Data of the Data Subject is necessary to allow access to the Site, its use and improvement, and to allow Madosto to:

• Carry out operations relating to its commercial relationship with the Data Subject, i.e. invoicing, accounting, monitoring the "customer relationship" with a Customer or Subscriber, such as carrying out satisfaction surveys, managing complaints, using the Site and more generally the services, etc. ;
• Select Customers or Subscribers to carry out studies, surveys and product tests, as well as loyalty, prospecting and promotion actions;
• To personalise its communications to Customers or Subscribers, in particular by means of information emails, according to their preferences and use of the Site;
• Carrying out prospecting operations, i.e. managing technical prospecting operations (including technical operations such as standardisation, enrichment and de-duplication);
• Carrying out commercial solicitations;
• The development of commercial statistics; analyzes and marketing tools (notably classification, score, etc.)
• The organisation of competitions, lotteries or any other promotional operation, with the exception of online gambling subject to approval by the Autorité de Régulation des Jeux en Ligne;
• The management of requests to exercise Specific Rights under the conditions of the paragraph “Specific Rights”;

Storage of Personal Data

The Site is hosted by the company whose contact details are available in the General Terms and Conditions of Use, accessible from the footer of the site.

All precautions have been taken to store the Personal Data of Data Subjects in a secure environment and prevent them from being distorted, damaged or accessed by unauthorized third parties. The information transmitted by the Data Subject will never be transmitted to third parties for commercial purposes nor sold or exchanged, without express and prior consent on their part.

Collection of Personal Data on the Site

Madosto collects, where applicable when creating an Account and then when it is gradually completed, the following Personal Data that the Customer and Subscriber provides and communicates during navigation and which are kept for a period of three (3) years, on an active basis, from the last connection of the Data Subject to the Site:

• Sex,
• Date of birth,
• Email address,
• Identifier used on the Site,
• Payment ID,
• Delivery address,
• Billing address,
• Phone number,

Connection data (date, time, IP address, pages consulted) of the Person Concerned when browsing the Site and, in particular, data relating to the use of Specific Services by the Subscriber.

The data entered by the Subscriber on the Site when using the Specific Services.

If applicable, the reason(s) for the exclusion (all the information needed to demonstrate the behaviour, which is less than one month old and justifies the exclusion).

The above Personal Data is also kept in Intermediate Archiving for an additional period of two (2) years in accordance with the common limitation period.

The above Personal Data is also kept in Intermediate Archiving for an additional period of seven (7) years, in accordance with Madosto's tax and accounting obligations.

Only Personal Data designated on the Site as mandatory are essential to benefit from an Account.

Recipients or recipient categories if they exist

Madosto may communicate to third parties certain Personal Data which is necessary for the completion of Orders within the framework of the General Conditions of Sale or the Subscription within the framework of the General Conditions of Service, in order to ensure in particular:

• the fight against fraud,

Security of Internet transactions

In accordance with the General Conditions, the Site uses the technology of different PSP (Payment Service Provider) companies to secure the banking transactions of Customers and Subscribers.

Thus, when paying on the Site, the bank details of the Data Subject are transmitted encrypted to the company which processes the payment, without Madosto being able to take note of them.

Madosto does not collect the full number of the Customer's bank card or Subscription, nor its cryptogram.

Specific Rights

In accordance with the Personal Data Regulations, the Data Subject may, at any time, benefit from the following Specific Rights from/to:

• access,
• correction,
• erasure,
• limitation of processing,
• portability,
• opposition,
• post-mortem guidelines.

Access rights

The Data Subject has the possibility of obtaining from Madosto confirmation that the Personal Data concerning him or her are or are not processed and, when they are, access to said Personal Data as well as the following information:

• the purposes of the processing;
• categories of Personal Data;
• the recipients or categories of recipients to whom the Personal Data have been or will be communicated;
• when possible, the planned retention period of Personal Data or, when this is not possible, the criteria used to determine this period;
• the existence of the right to request from Madosto the rectification or erasure of Personal Data, or a limitation of the processing of its Personal Data, or the right to object to this processing;
• the right to lodge a complaint with the CNIL;
• when Personal Data is not collected from the Data Subject, any available information as to their source;
• the existence of automated decision-making, including profiling, and, at least in such cases, meaningful information regarding the underlying logic, as well as the significance and intended consequences of such processing for the Data Subject .

When Personal Data is transferred to a third country or to an international organization, the Data Subject has the right to be informed of the appropriate guarantees with regard to this transfer.

Madosto provides a copy of the Personal Data subject to processing.

Madosto may require payment of a reasonable fee based on administrative costs for any additional copies requested by the Data Subject.

When the Data Subject submits their request electronically, the information is provided in commonly used electronic form, unless they request otherwise.

The Data Subject's right to obtain a copy of their Personal Data must not infringe the rights and freedoms of others.

Rights of rectification

The Data Subject has the possibility of obtaining from Madosto, as soon as possible, the rectification of Personal Data concerning him or her which is inaccurate. It also has the possibility of obtaining the completion of incomplete Personal Data, including by providing a supplementary declaration.

Rights to erasure

The Data Subject has the possibility of obtaining from Madosto the erasure, as soon as possible, of Personal Data concerning him or her when one of the following reasons applies:

• the Personal Data is no longer necessary for the purposes for which it was collected or otherwise processed by Madosto;
• the Data Subject has withdrawn consent for the processing of this Personal Data and there is no other legal basis for the processing;
• the Data Subject exercises his or her right of opposition under the conditions set out below and there is no overriding legitimate reason for the processing;
• the Personal Data has been the subject of unlawful processing;
• Personal Data must be erased to comply with a legal obligation;
• the Personal Data was collected from a child.

Rights to limitation

The Data Subject has the possibility of obtaining from Madosto the limitation of the processing of his or her Personal Data when one of the following reasons applies:

• Madosto verifies the accuracy of the Personal Data following the challenge by the Data Subject to the accuracy of the Personal Data;
• The processing is unlawful and the Data Subject objects to the erasure of the Personal Data and instead demands the restriction of their use;
• Madosto no longer needs the Personal Data for the purposes of processing but they are still necessary for the Data Subject to establish, exercise or defend legal rights;
• The Data Subject has objected to the processing under the conditions set out below and Madosto verifies whether the legitimate reasons pursued prevail over the reasons alleged.

Right to Data Portability

The Data Subject has the possibility of receiving Personal Data concerning him or her from Madosto, in a structured, commonly used and machine-readable format when:

• The processing of Personal Data is based on consent, or on a contract. And,
• The processing is carried out using automated processes.

When the Data Subject exercises his or her right to portability, he or she has the right to obtain that the Personal Data is transmitted directly by Madosto to another data controller whom it will designate when technically possible.

The right to portability of the Personal Data of the Data Subject must not infringe the rights and freedoms of others.

Right to object

The Data Subject may object at any time, for reasons relating to their particular situation, to the processing of Personal Data concerning them based on the legitimate interests of Madosto. The latter will then no longer process the Personal Data, unless it demonstrates that there are compelling and legitimate grounds for the processing which prevail over the interests and rights and freedoms of the Data Subject, or may keep them for the purposes of processing. establishment, exercise or defense of legal rights.

Post-mortem guidelines

Exercise of Specific User Rights

A response will be sent to the Data Subject within a maximum of one (1) month following the date of receipt of the request.

Product Presentation

Madosto offers the Customer the opportunity to purchase Product(s) of their choice offered on the Site.

The Customer can, prior to his Order, read, directly on the Site, the characteristics of the Product(s) he wishes to order.

Conditions and terms of the Order

Geographical area

Orders can only be delivered to European territory and the United Kingdom. Orders that do not meet these geographical limitations cannot be taken into consideration.

Conditions of validity of the Order

Orders placed on the Site can only be placed for personal purposes as declared and acknowledged by the Customer. In this regard, Madosto reserves the right to limit the number of Orders placed, if too large a number would suggest commercial use of said Products.

These restrictions may apply to Orders placed using the same credit card, or using the same billing and/or shipping address.

The Customer is prohibited from reselling Products. Madosto reserves the right to prohibit sales to any Customer reselling Products.

Order Process

The Customer, to place an Order, must go to the Site, purchase the Product(s) of their choice, by clicking on the “Add to Cart” button while specifying the number of Products desired.

From the “Shopping Cart” page of the Site, the Customer enters their delivery and billing address and expressly accepts the terms of these General Conditions of Sale by checking the corresponding box then proceeds to pay the amount of the Order by credit card.

The Order placed by the Customer will only be final upon effective payment of the amount of the Order by the Customer.

Confirmation of the Order by Madosto

Any Order placed by a Customer on the Site is subject to immediate written confirmation from Madosto, sent by email to the Customer.

An email is also sent to the Customer to inform them of the shipment of the Product(s) purchased.

Availability of Products

Madosto undertakes to deliver the Products within the limits of available stocks.

If any of the Products are unavailable, the Customer will be informed :

• or, when the Order is placed on the Site and the sale cannot be completed;
• or, after payment of the price, by email, as soon as possible. Madosto will reimburse the price of the unavailable Product(s) to the bank account used for the Order, within thirty (30) days from the notification sent to the Customer.

Price and payment

The prices displayed on the Site for each Product are indicated in euros, all taxes included.

Payment is made by bank card exclusively (CB, Visa, MasterCard) on the Site.

Payments by PayPal, American Express or other payment methods will not be accepted.

Payment is made on the Site through a secure banking platform, which is managed by a third party company. In this context, Madosto does not have the Customer's payment information at any time and cannot be held responsible in the event of fraudulent use of the payment methods used.

Delivery

Delivery terms

Each delivery of Product is deemed to have been made as soon as the package is made available to the Customer.

Without prejudice to the period available to the Customer under his right of withdrawal, we advise the Customer to check the parcel on arrival and to make any reservations if necessary, or even to refuse the parcel if it is likely to have been opened or if it bears obvious signs of deterioration. We advise you to send your reservations and complaints to the carrier by registered letter with acknowledgement of receipt within three working days of receiving the Product. The Customer may send a copy of this registered letter with acknowledgement of receipt to Madosto.

Delivery delay

All Products are delivered by post within 4 to 7 working days.

If the delivery date is exceeded by more than 30 days, the Customer may cancel the Order for the Product(s), by registered letter with acknowledgement of receipt or by writing on another durable medium, if, after having requested Madosto to deliver the Product(s) within a reasonable additional period, Madosto has not done so within this period.

The Order shall be deemed cancelled on the date of receipt by Madosto of the letter or writing informing it of such cancellation, unless Madosto has performed in the meantime.

In this case, Madosto reimburses the Customer, as soon as possible and at the latest within thirty (30) days from receipt of the aforementioned letter of formal notice, the price of the Product(s). subject of the Order, as well as the delivery costs invoiced to the Customer.

Delivery price

The amount of delivery is invoiced to the Customer according to the amount specified on the Site at the time of the Order.

Right to retract

In accordance with the provisions of Article L. 221-18 et seq. of the Consumer Code, the Customer may exercise his right of withdrawal to the extent that the nature of the Products purchased does not preclude this. The Customer may decide to withdraw from his Order, without it being necessary to give a reason, for a period of fourteen (14) clear days from receipt of the Product.

The Customer who wishes to exercise his right of withdrawal must inform Madosto no later than the fourteen (14) day period provided above by sending Madosto the duly completed Withdrawal Form by email or postal mail.

In the event of sending the Customer several Products by several independent shipments, making up a single Order, this withdrawal period runs from receipt by the Customer of the last of the Products making up the Order.

As soon as possible following receipt by the Customer of the Withdrawal Form materializing the Customer's desire to exercise his right of withdrawal, Madosto acknowledges receipt to the Customer by email.

The Customer, without undue delay and, at the latest, within fourteen (14) days from the communication of his decision to withdraw to Madosto, returns the Product(s) concerned to Madosto at postal address specified in the Withdrawal Form and following the terms specified in the said Withdrawal Form and in the information note attached to the latter.

The costs linked to the return of the Product(s) subject to the right of withdrawal are the sole responsibility of the Customer.

The exercise of the right of withdrawal must be made subject to the good faith of the Customer who in particular undertakes to return the Product(s) only in perfect condition (not damaged, soiled, not unsealed), in their original condition. original packaging accompanied by any possible accessories and documentation, which implies in particular that the Product(s) have not been subject to any use improper for their return.

The returned Product(s) must also be accompanied by the invoice for the Order so that Madosto can identify the Order and the Customer concerned.

The Customer assumes responsibility if the Product arrives at Madosto damaged or in a condition that does not permit its resale or in a depreciated state resulting from handling other than that necessary to establish its nature and/or characteristics.

In the event of receipt by Madosto of Product(s) subject to the right of withdrawal not allowing Madosto to ensure reimbursement, Madosto informs the Customer by email and returns the Product(s) concerned. ).

By exercising the right of withdrawal under the conditions defined in this article, Madosto will reimburse the Customer for the price of the Product(s) subject to the right of withdrawal, including delivery costs. .

The Customer's reimbursement for the right of withdrawal will be made by the same means of payment as that used by the Customer for the acquisition of the Product(s), namely by transfer to his bank account associated with the bank card. with which he made the payment which the Customer accepts without reservation, at the latest within thirty (30) days from receipt by Madosto of the Product(s) subject to the right of withdrawal .

Legal and contractual guarantees

Madosto is liable for defects in conformity of the Products under the conditions of the Consumer Code and for hidden defects of the Products under the conditions of the Civil Code.

When acting under the legal guarantee of conformity, the Customer :

• has a period of two (2) years from the date of delivery of the Product to take action,
• can choose between repairing or replacing the Product, subject to the cost conditions provided for by the Consumer Code,
• is exempted from proving the existence of the lack of conformity of the good during the twenty-four (24) months following the delivery of the Product.

The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted. 

The Customer can also decide to implement the guarantee against hidden defects in the Product within the meaning of the Civil Code and in this case, he can choose between the resolution of the sale or a reduction in the sale price in accordance with the Civil Code.

Securities

In the event of difficulties of interpretation between one of the titles appearing at the head of the clauses of these General Terms and Conditions of Sale and one of the clauses, the titles will be declared non-existent.

Applicable law and dispute resolution

These General Conditions of Sale are subject to Estonian law.

In the event of a dispute likely to arise in connection with these General Conditions of Sale, their interpretation and their consequences or with the acts supplementing or modifying them, the Customer will contact Madosto in order to try to obtain an amicable solution. Any complaint to Madosto must be made in writing.

In the absence of amicable settlement, the Customer can choose:

• To resort to an amicable mediation solution within a maximum period of one (1) year from the written complaint made by the Internet user to Madosto by contacting, (i) either a mediator of his choice, (ii) or by using the online dispute resolution system accessible at the following address: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage, it being specified that the process proposed mediation cannot be a precondition for referral to the competent courts for the Internet user.

Withdrawal effects

If you withdraw from this contract, we will refund all payments received from you, including the cost of delivery (with the exception of any additional costs incurred as a result of you choosing a delivery method other than the cheaper standard delivery method offered by us) without undue delay and, in any event, no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will make the refund using the same method of payment that you used for the original transaction, unless you expressly agree to a different method; in any event, this refund will not incur any costs for you.
